1. GENERAL
1.1 This End User License Agreement (“EULA”) sets forth the contractual terms and conditions (“Terms”) between you (“Licensee”, “User”, “You/you”, “Your/your”) and RV Audio Design (collectively, “RV Audio Design”, “Licensor”, “we”, “us”, or “our”) for the use of RV Audio Design’s Software. This includes, but is not limited to, information, data, documents, images, photographs, graphics, audio, videos, or webcasts, and Licensed Software (defined below) including related media, documentation (such as program descriptions or manuals), and any other materials manufactured by RV Audio Design (“Software”). By accepting this agreement or using the Software, you agree to all of these terms. If you do not accept and comply with these terms, you may not use the Software or its features.

1.2 RV Audio Design reserves the right, at its sole discretion, to change, modify, add, or remove portions of these Terms at any time. It is your responsibility to check these Terms periodically for changes. Your continued use of the Software following the posting of changes will mean that you accept and agree to the changes. RV Audio Design will make the current version of the Terms available at www.rvaudiodesign.com/EULA (“Website”). Your use of the Software is subject to the most current version of the Terms at the time of such use.

1.3 Your use of the Software is also governed by this EULA and RV Audio Design’s Terms of Use, available at Terms and Conditions.

2. APPLICABILITY
This license agreement applies to all RV Audio Design Software, plug-ins, and programs that you may use during the Evaluation period and/or thereafter, subject to an acquired license key. This includes any and all versions, upgrades, supplements, or services, unless other terms accompany such versions or services.

3. REGISTRATION/ACTIVATION
3.1 It is required that you register the Software in order to activate and use it on your computer.

4. ACCEPTANCE OF TERMS
4.1 By installing and registering the Software, you declare yourself in agreement with these Terms. If you do not agree with these Terms, you must not install or use the Software.

4.2 You may not use the Software if:

(a) you are prohibited by law from receiving or using the Software, or
(b) you are not fully able and competent to enter into a binding contract with RV Audio Design, such as if you are not of legal age and/or have not obtained verifiable parental consent.
4.3 RV Audio Design may require you to provide consent to updated Terms before further use of the Software is permitted. Otherwise, your continued use of any Software constitutes your acceptance of the changes.

5. APPLICABLE LAW
5.1 This license agreement is governed by Dutch law. The courts of Amsterdam are authorized to rule on any dispute that may arise from this license agreement.

6. LICENSE
6.1 The Software is licensed to the Licensee, not sold. RV Audio Design grants the Licensee the right to use the Software under the terms of this agreement.

6.2 This agreement allows the Licensee to install and use the Software on a maximum of 2 devices at a time.

7. RESTRICTIONS
7.1 The Licensee may not install or provide use of the Software on a network.

7.2 The Licensee may not, without written permission from RV Audio Design, reverse engineer, disassemble, decompile, modify, alter, or otherwise reduce the Software in whole or in part to a human-perceivable form.

7.3 The Licensee may not electronically transmit the Software in whole or in part from one computer to another or over a network.

7.4 The Licensee may not rent, lease, loan, or distribute the Software in whole or in part.

8. AUTHORIZATION PROCEDURE
8.1 The Software will function properly only after the correct ‘response code’ has been obtained from RV Audio Design by the Licensee.

8.2 The Licensee agrees to follow the procedure for obtaining a ‘Response code’. Licensee understands that the authorization procedure ties the Software to a single computer.

9. DURATION AND EVALUATION
9.1 All licenses will be granted for perpetuity (meaning that the license agreement shall not automatically expire), as long as all conditions herein are respected.

9.2 The Evaluation period is a period of seven (7) days commencing on the first day of using the Software and automatically expiring 7 days thereafter. After the Evaluation period has expired and no license key has been acquired, the Software will stop functioning properly.

9.3 RV Audio Design may terminate the license without prior notice in cases of abuse or if the Licensee files for personal bankruptcy.

9. Analytics and Data Collection
9.1 By using this software, you agree to the collection of certain usage analytics and diagnostic data. This data may include, but is not limited to:
– Plugin usage statistics (e.g., feature usage, session duration).
– Non-identifiable system information (e.g., operating system version, host application).
– License information
– Crash reports and error logs.

10. Privacy Policy
We take your privacy seriously. Any personal data collected through our website or products is kept confidential and is only shared with third-party services as required to process payments or deliver services. Please refer to our Privacy Policy for more information on how we handle and protect your data.

11. SUPPORT
10.1 RV Audio Design will use reasonable commercial efforts to provide support for any major version of its Software, including email support.

10.2 RV Audio Design may terminate support for any major version of the Software at any time at its sole discretion.

12. Governing Law and Disputes
12.1 Any disputes arising from the use of our Software, its services, or the purchase and use of any products sold by RV Audio Design shall be exclusively resolved under Dutch law and handled by the Dutch courts in The Hague.

13. DISCLAIMER
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RV AUDIO DESIGN SPECIFICALLY DISCLAIMS ALL WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF NON-INFRINGEMENT, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE. RV AUDIO DESIGN DOES NOT WARRANT THAT THE SOFTWARE WILL MEET YOUR REQUIREMENTS OR THAT THE SOFTWARE WILL OPERATE ERROR-FREE OR UNINTERRUPTED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, RV AUDIO DESIGN SHALL NOT BE LIABLE FOR ANY DAMAGE A PRODUCT MAY CAUSE OR DAMAGES THAT MAY ARISE OUT OF THE USE OR INABILITY TO USE A PRODUCT, INCLUDING BUT NOT LIMITED TO SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR OTHER DAMAGES.

The Licensee confirms having read this agreement before installing or using the Software. If you do not agree to the terms of the agreement, do not install or use the Software. If you have received a physical package, promptly return it with the original receipt for a refund.
